A farmer has been ordered to pay up a staggering $92,000 (£71,600) after sending a thumbs-up emoji in a text. Chris Achter was speaking with Kent Mickleborough, a grain buyer who worked for South West Terminal Ltd (SWT). A contract for 86 tonnes of flax for $25 a bushel was drafted between the pair, and the order was expected to arrive in November. Mickleborough signed the document and sent Achter a photo, writing: "Please confirm flax contract". Achter responded with a thumbs-up emoji – but the order did not arrive by the intended date. The Court of King’s Bench in the Canadian province of Saskatchewan has said the Canadian farmer must pay a fee of $92,000. They believe the emoji confirmed the contract, which was later breached. In the legal documents, Achter claimed his use of the emoji was to confirm he had received the document and "understood the complete contract would follow by fax or email." He went on to deny that he accepted the emoji as a digital signature of the "incomplete contract," adding: "I did not have time to review the Flax Contract and merely wanted to indicate that I did receive his text message." Meanwhile, the buyers adamantly believed the emoji signified Achter accepted the contract. According to AU News, Justice Timothy Keene summarised the case by saying the case "led parties to a far-flung search for the equivalent of the Rosetta stone in cases from Israel, New York State and some tribunals in Canada, etc. to unearth what a [thumbs-up] emoji means." "This court readily acknowledges that a [thumbs-up] emoji is a non-traditional means to ‘sign’ a document, but nevertheless, under these circumstances, this was a valid way to convey the two purposes of a 'signature.'" He continued: "This Court cannot (nor should it) attempt to stem the tide of technology and common usage – this appears to be the new reality in Canadian society, and courts will have to be ready to meet the new challenges that may arise from the use of emojis and the like." Former President Donald Trump’s legal team suffered a setback on Tuesday as a federal judge commented that his argument for moving a trial on 34 counts of falsifying business records out of state court was “far-fetched”. The comments from Judge Alvin Hellerstein were reported by NBC 4; the criminal prosecution is one of two the former president is now embroiled in as his legal entanglements continue to worsen. Mr Trump is accused in New York of falsifying business records dozens of times with the purpose of hiding a well-reported hush money scheme in which he supposedly paid his former attorney to recompense payments that the attorney, Michael Cohen, made to adult film star Stormy Daniels and other women with tales of alleged extramarital affairs with his boss. The former president has denied both the allegations of extramarital affairs as well as his own supposed role in covering them up; his ex-attorney Cohen, however, has explained his boss’s role in the scheme. Mr Trump’s attorneys had sought to see the case moved from court in New York state to a federal jurisdiction, as part of an effort to see the case dismissed on grounds that he supposedly made the payments in 2017 as part of his work as president. On Tuesday, Mr Hellerstein appeared to scoff at that argument. “It sounds a little far fetched, but that's the argument,” Mr Hellerstein reportedly said. He is set to make a final ruling on this matter within two weeks. He also added that as of yet, the Trump attorneys had provided “no reason to believe that an equal measure of justice could not be rendered by the state court”, and given no convincing evidence or arguments to support the idea that there was a “relationship to any official act of the president” and the payments. The husband of a Georgia mother-of-four who disappeared more than two weeks ago has been arrested for her murder. Imani Roberson was last seen on 16 July in Conyers, where she was leaving her mother's home. Her car was later found burned and broken into pieces near Atlanta, approximately 24 miles away, according to NBC News. Her body was reportedly found on Friday. Her husband Donell Anderson was then arrested at an apartment complex in Atlanta, and was charged with felony murder, malice murder, aggravated assault, and possession of a firearm, according to Rockdale County Sheriff Eric Levett. He said during a news conference that more arrests were coming in the case. "This investigation is still ongoing and I can assure you that another arrest will be made," he told reporters. Police said Roberson disappeared after she and her four children visited her mother's house for a family dinner. She left two of the children with her mother and returned home with her three-year-old and one-month-old. The next day Roberson's mother called her repeatedly, but she did not answer. When she traveled to her daughter's house to find her, she found no one there. She filed a missing person's report on 17 July. All four of Roberson's children are currently safe, police said. Clarine Andujar-White, Roberson's mother, said the day that Mr Anderson was charged had been a "very difficult day" for her family. "When I couldn’t reach Imani almost three weeks ago, I knew something was wrong," she said. "Late last night my worst fears were confirmed and our family is devastated." Her father, Ronald Acklin, said that it was "not the news" the family was hoping for. The Rockdale County Sheriff's Office has asked members of the public with information regarding Ms Roberson's disappearance to come forward. "Put yourself in the shoes of this family. Mikel Arteta has not ruled out returning to the transfer market as he expects Arsenal to be without Jurrien Timber for the season after the summer signing suffered a knee injury against Nottingham Forest. It was confirmed earlier in the week that Dutch defender Timber will go under the knife after tests showed ligament damage – with Arteta also insisting the number of serious injuries suffered so early into the campaign is a “big worry” for player welfare. Timber limped out of Saturday’s 2-1 Premier League win over Forest on Saturday, with the club confirming on Wednesday he suffered ligament damage. The PA news agency understands Timber felt no immediate pain after a challenge with Brennan Johnson just before half-time and underwent stringent tests during the interval. Club medical staff believe the outcome of the injury would not have changed had he been substituted immediately instead of playing on for five minutes of the second half before being replaced by Takehiro Tomiyasu. Asked about Timber’s situation, Arteta said: “Huge blow. Especially for him after just joining the club. To have the injury he has is a huge blow. “It is for the team because we recruited him with clear intentions and what he was bringing to the team was evident and he’s not going to be able to do it this season for us. We have to adapt. These things happen unfortunately and we have to move on. “He’s been very good to be honest. He’s a special character. He knows, he’s starting to realise the extent of the injury and the amount of time he’s going to be out. But he’s in a good place.
